Migration work involves some of the most sensitive information a person holds. This policy explains what we collect, why we need it, who we give it to, and what you can ask us to do with it.

Scope

Who this policy applies to.

This policy applies to personal information handled by Koala Solutions in the course of providing immigration assistance and recruitment services. We handle personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles, and in accordance with the confidentiality and record-keeping obligations imposed on registered migration agents by the Code of Conduct.

What we collect

We collect the information reasonably necessary to assess and prepare a migration matter. Depending on the matter, that can include your name, date of birth, nationality and passport details; contact details; visa and travel history; qualifications, English test results and skills assessments; employment history and income; relationship and family details; and, where relevant to a visa criterion, sensitive information such as health and police records.

We collect this information directly from you wherever possible — usually through the pre-assessment form, consultations and documents you provide. Sometimes we receive it from a third party you have authorised, such as a sponsoring employer, a family member applying with you, or an assessing authority.

Why we collect it

To assess eligibility, advise you, prepare and lodge applications, correspond with the Department of Home Affairs and the Administrative Review Tribunal on your behalf, meet our professional and legal obligations, and administer our relationship with you including billing. If you choose not to provide information we ask for, we may be unable to advise you or act for you.

Who we disclose it to

We disclose personal information only as needed to act for you or as required by law. That typically includes the Department of Home Affairs and, where relevant, the Administrative Review Tribunal; skills assessing authorities, English test providers, panel physicians and police-check agencies; state and territory nominating bodies; and translators or interpreters. Where you are sponsored, we may disclose relevant information to the sponsoring employer with your consent.

Some service providers we use — including software and email providers — may store data outside Australia. We take reasonable steps to ensure such providers handle personal information consistently with the Australian Privacy Principles. We do not sell personal information.

Storage and security

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure, using a combination of physical, technical and administrative measures. Client records are retained for as long as required by our professional obligations and applicable law, and are destroyed or de-identified when they are no longer needed and retention is no longer required.

Access and correction

You can ask for access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date or incomplete. Contact us at info@koalaz.com.au. We may need to verify your identity, and in limited circumstances permitted by the Privacy Act we may decline access, in which case we will explain why.

Complaints

If you believe we have mishandled your personal information, contact us first at info@koalaz.com.au or (02) 9567 6045 so we can investigate. If you are not satisfied with our response, you can complain to the Office of the Australian Information Commissioner. Complaints about the professional conduct of a registered migration agent can be made to the Office of the Migration Agents Registration Authority.
